Definitions
"The Company" means Space Studios Ltd.
"The Client" means the person who has made and is responsible for the booking.
"Session" is the pre-agreed duration of the visit by the client to the studio in order to carry out work agreed.
These Terms and Conditions apply to all facets of the work undertaken by the Company and facilities supplied by the Company with respect to the Session booked by the Client, but not limited solely to the Client.
1. AGREEMENT
These Terms and Conditions apply to all work done by the Company and facilities supplied by the Company for the Client.
2. STUDIO FACILITIES
2.1 The Company shall make relevant rooms of the studio and staff available to the Client for the Session. The Company reserves the right to make alternative rooms available to the client which it deems are suitable for the Client's purposes.
3. THE CLIENT UPON BOOKING AGREES TO:
3.1 Ensure the suitability of the Company Studio for the Client's purpose including all equipment, parking, times, rest areas etc.
3.2 Behave while on studio premises and ensure the good behaviour of all its personnel.
3.3 Occupy the studio or any other room hired for the session only for the time agreed. Any extra time is allocated at the discretion of the Company and will be charged accordingly.
4. THE FEES
4.1 All bookings are subject to a non-refundable deposit of 50% of the price of the booking, payable 30 days in advance of the booking. If the booking is made less than 30 days in advance of the session, the deposit will be paid on booking. The booking is not confirmed until the deposit is paid and cleared.
4.2 The Client shall be invoiced for and shall pay the whole of the Fees upon completion of the session. If payment is not made at the end of a session, if not otherwise agreed, the Company can withhold any recorded material until payment has been made in full. Interest will be charged at 5% above Bank of England base rate for late payments. Payment terms given at the discretion of the Company.
4.3 The Client agrees that the Company offer no forms of return or money back policies.
4.4 Cancellations must be made and agreed between the Client and Company within the following timescales:
Rehearsal sessions: 48 hours' notice
If less than 48 hours' notice, 50% of the session fee is payable.
If less than 24 hours' notice, 100% of the session fee is payable.
Recording sessions: seven days before the Session.
If less than seven days' notice, 100% of the session fee is payable.
5. MEDIA, PERSONNEL AND EQUIPMENT
5.1 The Company will supply blank media to deliver the recording to the client. Any duplicates will be charged to the Client.
5.2 The Client undertakes and agrees that it shall be responsible:
5.2.1 for the actions of the Client's Personnel upon the Company's premises.
5.2.2 for any and all injury, loss or damage to any person's equipment or premises caused by any act or omission of the Client's Personnel, or as a result of any defect in or inappropriate specification of the Client's Equipment or the Client's Own Media.
5.2.3 The Company is not responsible for any loss or damage of the client's equipment left at the company's premises for the duration of the booking. The Client must take responsibility for insuring equipment belonging to the Client. This includes vehicles parked outside the Company's premises, whether in the Cardiff Bay Business Centre car park or outside this area.
5.3 Equipment will be made available to the client only at the Company's discretion and a charge may be made for hire.
6. INDEMNITY
The Client hereby agrees that the Company shall not be liable for any injury, loss, damage, costs and/or expenses suffered by the Client arising from:6.2 the Client's making, use or exploitation of the Recordings
6.3 any copyright issues with the Client's Recorded Material, including anything that constitutes a breach or infringement of any copyright or which shall be in any way illegal. The Client will indemnify the Company against any liability in respect thereof and shall pay all costs and expenses which may be incurred by the Company in reference to any such claim. The indemnity shall extend to any amount paid on a lawyer's advice in respect of any such claim
7. STUDIO CANCELLATION AND BREAKDOWN
7.1 In the rare instances that the Company must cancel a booking, the Client will either get a rescheduled booking or a refund of any deposits paid.
8. TERMS AND CONDITIONS ARE DEEMED TO HAVE BEEN ACCEPTED BY THE CLIENT ON MAKING A BOOKING.
